Como siempre, pongamos un ejemplo:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Luisa quiere vender su segunda residencia que est\u00e1 en Valencia. Como su hija vive en Valencia, ha decidido que sea ella la que vaya a firmar. En ese caso, Luisa tendr\u00e1 que dar un poder notarial a su hija. Luisa, como persona que da el poder, ser\u00eda la poderdante y su hija la apoderada.<\/span><\/i><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9a77de0 elementor-widget elementor-widget-spacer\" data-id=\"9a77de0\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cf797d7 elementor-widget elementor-widget-text-editor\" data-id=\"cf797d7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<h2><b>Tipos de poderes notariales<\/b><\/h2><p><b>Hay muchos tipos de poderes notariales<\/b><span style=\"font-weight: 400;\">. De hecho, hay un tipo de poder notarial por cada acto jur\u00eddico que permite la figura de un representante. Y es importante recalcar ese punto porque <\/span><b>no se pueden otorgar poderes para cualquier acto jur\u00eddico.<\/b><span style=\"font-weight: 400;\"> Hay algunas excepciones, como las herencias, en las que no se admiten representantes.<\/span><\/p><p><span style=\"font-weight: 400;\">Explic\u00e1ndole la situaci\u00f3n al notario este podr\u00e1 asesorarte sobre el tipo de poder notarial que es recomendable otorgar.<\/span><\/p><p><span style=\"font-weight: 400;\">Teniendo esto en cuenta, <\/span><b>si queremos agrupar los tipos de poderes notariales<\/b><span style=\"font-weight: 400;\">, podr\u00edamos dividirlos en tres; poder para pleitos, poder para administrar bienes y poder general.<\/span><\/p><h3><b><i>Poder para pleitos<\/i><\/b><\/h3><p><span style=\"font-weight: 400;\">Es el apoderamiento \u201capud acta\u201d en el que se designa a una persona o empresa para representar al apoderante en un pleito. Es algo <\/span><b>habitual cuando contratamos a un\/a abogado\/a. <\/b><span style=\"font-weight: 400;\">Tambi\u00e9n es un tipo de poder habitual en las empresas que tiene su propio departamento legal.<\/span><\/p><h3><b><i>Poder para administrar bienes<\/i><\/b><\/h3><p><span style=\"font-weight: 400;\">Da el poder al apoderado de gestionar los bienes del apoderante. <\/span><b>En este tipo de poder se suele recomendar excluir los actos de disposici\u00f3n, como las compraventas<\/b><span style=\"font-weight: 400;\">. Por ejemplo, le damos poder para alquilar una vivienda, pero no le damos poder para venderla, y tampoco puede disfrutar de la misma. Por lo tanto, para hacer un poder notarial tienes que dirigirte a una notar\u00eda. <\/span><b>Al explicarle al\/la notario\/a la situaci\u00f3n y las necesidades, te guiar\u00e1 sobre hasta d\u00f3nde es recomendable que llegue el poder notarial.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">La persona que designas como tu representante, el apoderado, no tiene por qu\u00e9 estar presente en el momento de la firma del poder notarial.<\/span><\/p>\n<h3><b><i>\u00bfCu\u00e1nto cuesta un poder notarial?<\/i><\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Como ocurre con todas las escrituras, <\/span><b>un poder notarial no tiene un precio fijo<\/b><span style=\"font-weight: 400;\">. Depender\u00e1 sobre todo de la extensi\u00f3n del mismo. Por ejemplo, un poder para pleitos, puede costar alrededor de 50\u20ac. Es decir, <\/span><b>si t\u00fa das un poder notarial a otra persona, puedes revocarlo cuando lo consideres oportuno.<\/b><span style=\"font-weight: 400;\"> Tambi\u00e9n pod\u00e9is fijar en la escritura una caducidad. Por ejemplo, marcar una fecha exacta en el que caduca el poder notarial.
